Mainali’s case to gain momentum

Following the Tokyo High Court’s rejection of the government attorney’s plea to scrap the court’s decision to review the case of Govinda Mainali, advocates declared on Thursday the case would not be taken to the Supreme Court.

With the decision made by the government attorney, Mainali’s case is likely to gain momentum towards claim for monetary compensation, say sources close to the Mainali family.
 
So far, the government attorney had been advocating against Mainali’s release. He was given a clean-chit in a murder case after erroneously serving 15-year jail term.
 
Mainali, who hails from Ilam district, was given the clean chit on June 7. He arrived in Kathmandu on June 16. Mainali was detained by the Japanese authorities for ‘overstay’ in March 1997 and was accused of rape and murder charges two years later.
 
However, the court’s verdict to jail Mainali turned awry 15 years later after a DNA test proved that his semen did not match samples collected from the dead woman’s body. Eventually, following a retrial, Govinda was acquitted of all the charges.
